What a Conservative jurist is NOT

This article reports a Federal judge's order that FEMA (read: taxpayers) MUST continue to pay for hotel rooms of persons displaced from Hurricane Katrina (read: New Orleans residents) through Feb. 7th--more than 6 months after the hurricane.

It's debatable whether taxpayers should still be footing these bills, but the judge's order is what bothered me:

The judge said he based his ruling on the federal law that authorized FEMA. It requires the government to ease suffering and damage caused by natural disasters. The arbitrary deadline violates that legislation, Judge Duval wrote, and discriminates against victims based on their economic status.

I'm sorry, but there is no violation of the law in this case, and it is a judge trying to act as an Executive (or perhaps a Legislator) by establishing that "eas[ing] suffering" requires 6 months rather than 4 months of free housing.
